Today, we expect our solicitors to be served with the Government’s ‘Notice of Acknowledgement of Service and Summary Grounds of Resistance’ – which is legal-speak for its first, formal written defence to the which you can read here: arguments made in our judicial review claim.
We have asked the Government for permission to publish these documents, which we believe is in the public interest and will promote open justice. If they say ‘no’, which we think is likely, we will ask the Court to make a special Order allowing publication of the defence. Such an Order has been successfully sought once before by our Bindmans legal team. https://www.theguardian.com/…/government-must-disclose…
But until the Government agrees to be open, or such an Order is made, or the Court hearing on our case begins, we will not be able to say what is in the defence.
